Intentional Torts

  • Tort-a private or civil wrong
  • Intentional Torts are torts in which the defendant possessed the intent or purpose to inflict the reluctant injury.
  • The most common intentional torts include: assault, battery, false imprisonment,defamation, invasion of privacy, trespass to land, conversion, and fraud


Negligence, and Strict Liability

  • Negligence is the most common tort.
  • Intent to injure is not required for this tort. Only careless behavior is required for negligence.
  • Negligence is proven in court by showing of a duty of due care owned by the defendant to the plaintiff, a breach of that duty, causation and injury.
